El peticionario alegó la vulneración del debido proceso por tres causales: 1º.
Error en la apreciación de pruebas. 2º.
Error en la interpretación sistemático-contextual de la confrontación normativa planteada y; 3º.
Ejercicio de funciones con omisión de aspectos constitucionalmente relevantes incidentes en la decisión.
Por el incumplimiento de la debida carga argumentativa, la Sala Plena decidió RECHAZAR la nulidad propuesta en esta oportunidad.
Concluyó la Corte que lo que pretende el actor es la reapertura del debate jurídico resuelto, no soportado en ninguno de los supuestos materiales desarrollados por la Corte y utilizando la nulidad como un recurso judicial para cuestionar el sentido del fallo.
